COMMERCIAL RECORDING AND PHOTOGRAPHY AGREEMENT
- DESCRIPTION OF SERVICES: The Provider agrees to carry out the recording of audio and visual content, as well as the taking of photographs, in the Client’s business premises for the purpose of creating commercial content. This may include images and videos of the premises, products, services, as well as individuals present in the business.
- AUTHORIZATION FOR RECORDING AND PHOTOGRAPHY: The Client authorizes the Provider to record their image and voice, as well as to take photographs in the business premises. This authorization extends to all individuals present in the business premises during the provision of services.
- USAGE RIGHTS: The Client grants the Provider all rights to use, reproduce, and distribute the recorded and photographed content, including its use in printed media, digital platforms, and any other promotional or advertising format related to the business.
- CONFIDENTIALITY: The Provider agrees to maintain the confidentiality of any sensitive or confidential information that may be obtained during the provision of services, including the Client’s business, strategic, or financial information.
- PAYMENT AND FEES: The fees and payment terms will be separately agreed upon between the Provider and the Client, and will be detailed in an invoice issued by the Provider.
- LIABILITY: The Provider agrees to carry out the commercial recording and photography services with utmost care and professionalism. However, in the event of damages or losses caused by unforeseen circumstances, the Provider shall not be held liable for such damages or losses.
- CANCELLATION: Once the package purchase is made, no cancellation is accepted. Services can be rescheduled, subject to mutual agreement with a minimum of 15 days’ notice. In the event of cancellation by the Client within this timeframe, the Provider may retain the full payment as compensation for costs and reserved availability.
- APPLICABLE LAW: This Agreement shall be governed and interpreted in accordance with the laws of the state of Florida, and any dispute related to this Agreement shall be subject to the exclusive jurisdiction of the courts in Miami, Florida.
